Does GDPR affect me?

If your business is based in the European Union (EU), or you process the personal data of EU citizens, the General Data Protection Regulation (GDPR) affects you.

What is Consent?

According to the GDPR you must obtain freely given, specific, informed, and unambiguous consent from your subscribers. You also must clearly explain how you plan to use their personal data. Socital gives you the option to include configurable checkboxes for opt-in consent on your Socital Campaigns to help you with GDPR compliance.

Enabling consent checkboxes on Socital Campaigns does not make you fully compliant. It’s an important step in the process.

Socital offers tools and information as a resource, but we do not offer legal advice. You should seek legal counsel regarding your GDPR obligations as a data controller and what you need to do to comply.

Consent Logs

Socital stores the timestamp, IP address and exact consent text to which each subscriber has opted into, in order to help you comply with GDPR requirements.

Consent with Socital Onsite Campaigns

Socital offers the option for two different Consent types. You can enable any or both of them according to the legal advice of your counsel.

The two different types of Consent checkboxes that Socital offers are:

Generic Consent

This Consent type is intended for requesting Consent to your terms of service, the ways of processing the subscriber’s personal data and any other terms you may need to outline or get consent for.

This Consent type, when enabled, is by default required for subscribers to opt-into in order to proceed with the Call-to-Action of the Onsite Campaign.

Marketing Consent

The Marketing Consent type is intended for specifically requesting Consent to contact the subscriber for promotional purposes and send marketing material such as newsletters, sms campaigns, online advertising etc.

Is Marketing Consent required for my subscribers to proceed?

When Marketing Consent is enabled, you can choose to make it required for subscribers to opt-into in order to proceed with the Call-to-Action of the Onsite Campaign.

If you do not make this Consent type required, you may have individuals in your Socital account who have proceeded with the Call-to-Action, such as getting a discount coupon, but haven’t opted-into receiving marketing communication. Socital will not automatically sync or export those contacts to your email marketing tool.
